Church Response

Terms of Use

Effective October 1, 2026 · Version 2026-10-01

PLEASE READ THESE TERMS CAREFULLY. THEY LIMIT OUR LIABILITY, REQUIRE MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION, AND WAIVE CLASS ACTIONS AND JURY TRIALS. BY TAPPING OR CLICKING "I AGREE," OR BY USING CHURCH RESPONSE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE CHURCH RESPONSE.

1. Who we are and what these terms cover

Church Response is provided by Risk Strategy Group, LLC, a Texas limited liability company doing business as Church Response ("RSG," "we," "us"). These terms cover the Church Response phone app, the website at churchresponse.com, and the training, guides, templates, and other material we provide through them (together, the "Service").

"Church" means the church, ministry, or organization that signs up for the Service. "You" means any person who uses the Service, including a Church's administrators, team members, and volunteers.

If you accept these terms for a Church, you confirm that you are authorized to bind that Church, and "you" also means the Church.

2. NOT AN EMERGENCY SERVICE

THE SERVICE IS NOT AN EMERGENCY SERVICE AND IS NOT A SUBSTITUTE FOR 911. The Service does not contact 911, police, fire, or emergency medical services for you. Tapping a 911 button opens your phone's dialer. You must place the call yourself.

WE DO NOT GUARANTEE THAT ANY ALERT, MESSAGE, NOTIFICATION, OR LOCATION WILL BE SENT, DELIVERED, RECEIVED, SEEN, ACCURATE, OR TIMELY. Phones, networks, batteries, settings, app stores, and third-party services fail, and delays and outages will happen. Locations shown in the Service are approximate and may be wrong, delayed, or missing.

In any emergency, call 911 first. Do not rely on the Service to summon help or to protect anyone's life, health, or property.

3. The Church is responsible for its safety program

The Service is a communication and record-keeping tool. RSG does not provide security personnel, and it does not staff, supervise, train on site, direct, or control any Church's team or volunteers through the Service.

Each Church is solely responsible for:

  • who it allows on its team, and for screening and background checks;
  • its own policies, procedures, emergency plans, and use-of-force rules;
  • the training, qualification, licensing, and conduct of its team members and volunteers, including anyone who carries a weapon;
  • every decision made and action taken before, during, and after any incident;
  • complying with all laws that apply to it, including laws on security, weapons, privacy, records, and the protection of minors; and
  • the accuracy of everything it and its people enter into the Service.

4. Training, guides, and templates are general information

Training courses, quick reference guides, checklists, templates, and other material in the Service are general educational information. They are not legal, medical, or professional advice, and they are not tailored to any particular church, person, or situation.

Unless a course says in writing that it leads to a named certification, completing it does not certify, license, or qualify anyone for anything. First aid, CPR, AED, and bleeding control material does not replace hands-on certified training from an authorized provider.

Templates are starting points. The Church is responsible for adapting, reviewing, and adopting any template, and for how it is used.

5. Your account

Keep your login private and tell your Church administrator right away if you think someone else has used it. You are responsible for activity under your login. A Church administrator may add, change, or remove team members' access at any time.

6. Church content and data

"Church Content" means everything a Church and its people put into the Service, including rosters, schedules, messages, locations, incident reports, documents, and photos.

The Church owns its Church Content. It is the Church's record, not RSG's.

The Church gives RSG permission to host, store, copy, transmit, back up, and display Church Content only as needed to provide, secure, and support the Service, and as required by law.

RSG staff do not read a Church's content except to provide support the Church asks for, to keep the Service secure, to investigate misuse, or when the law requires it.

The Church is responsible for having any permission it needs from its members, volunteers, and visitors to enter their information into the Service, including consent to share location while on duty or during an alert.

Location. The app shares a team member's location with their Church only while that person is on duty, or while an alert they sent is open. It stops when they go off duty or the alert closes.

How we handle personal information is described in our Privacy Policy at churchresponse.com/privacy.

7. Acceptable use

You agree not to:

  • use the Service for anything unlawful, or to harass, threaten, or harm anyone;
  • send a false alert on purpose, except a drill clearly marked as a drill;
  • enter information you have no right to share;
  • try to access another Church's data, or any part of the Service you are not authorized to use;
  • interfere with, overload, reverse engineer, or copy the Service; or
  • resell or share access to the Service outside your Church.

We may suspend or end access for anyone who breaks these terms or puts others at risk.

8. Fees

Fees, if any, are set out in the Church's order or subscription. Fees paid are not refundable except where the law requires it or we say otherwise in writing.

9. Changes to the Service and these terms

We may change, add, or remove features at any time. We may update these terms. When we make a material change, we will ask you to agree again in the app or on the website before you keep using the Service.

10. Ending use

A Church may stop using the Service at any time. We may suspend or end the Service for a Church that breaks these terms or does not pay. After the Service ends, a Church administrator may request an export of its Church Content within 30 days. After that, we may delete it, except where the law requires us to keep it.

11. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, RSG DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. RSG DOES NOT WARRANT THAT THE SERVICE WILL PREVENT, DETECT, OR REDUCE ANY INJURY, DEATH, CRIME, OR LOSS, OR THAT ANY ALERT, MESSAGE, NOTIFICATION, OR LOCATION WILL BE DELIVERED OR ACCURATE.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT THE LAW ALLOWS:

(a) RSG, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, EVEN IF TOLD THEY WERE POSSIBLE.

(b) RSG WILL NOT BE LIABLE FOR ANY PERSONAL INJURY, DEATH, OR PROPERTY LOSS ARISING FROM ANY EMERGENCY, INCIDENT, CRIME, OR ACT OR FAILURE TO ACT BY A CHURCH, ITS PEOPLE, OR ANY THIRD PARTY, OR FROM ANY ALERT, MESSAGE, NOTIFICATION, OR LOCATION THAT WAS DELAYED, NOT DELIVERED, OR INACCURATE.

(c) RSG'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE FEES THE CHURCH PAID RSG FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR ONE HUNDRED U.S. DOLLARS ($100).

These limits apply to every legal theory, including contract, tort (including negligence), and strict liability. They are an essential part of the bargain, and the Service would not be offered without them.

13. Indemnity

The Church will defend, indemnify, and hold harmless RSG and its owners, members, managers, employees, contractors, and agents from all claims, damages, losses, fines, and costs (including reasonable attorneys' fees) arising from: (a) the Church's safety program, policies, decisions, or incidents; (b) the acts or failures to act of the Church's team members, volunteers, or visitors; (c) Church Content; or (d) any breach of these terms by the Church or its people.

14. Disputes: informal first, then individual arbitration

Informal resolution first. Before filing any claim, you agree to email us at help@churchresponse.com with a description of the dispute, and to try in good faith to resolve it for 60 days.

Binding arbitration. Any dispute that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its rules then in effect, and not in court. The arbitration will take place in Erath County, Texas, or by video. Judgment on the award may be entered in any court with jurisdiction. Either side may instead bring an individual claim in small claims court if it qualifies.

CLASS ACTION AND JURY TRIAL WAIVER. YOU AND RSG EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO BRING OR TAKE PART IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

Time limit. Any claim must be filed within one year after it arose, or it is permanently barred, to the extent the law allows.

15. Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules, and by the Federal Arbitration Act. For anything that is not arbitrated, the state and federal courts located in Erath County, Texas have exclusive jurisdiction.

16. Apple and Google app store terms

If you downloaded the app from the Apple App Store or Google Play, these terms are between you and RSG only, not Apple or Google. Apple and Google are not responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

17. General

These terms, the Privacy Policy, and any order the Church signs are the entire agreement about the Service. If any part of these terms is found unenforceable, it will be enforced to the fullest extent possible, and the rest stays in effect. Our failure to enforce a term is not a waiver. You may not transfer these terms without our written consent. We may transfer them in a merger, sale, or reorganization. Sections 2, 3, 4, 6, and 10 through 17 survive after use ends.
